COMPANIES’ RESPONSIBILITY FOR CRIMES AND ORGANIZATION MODELS

Italian Legislative Decree 231/2001 provides for a new form of responsibility for companies, a third type in between a criminal and an administrative one,  for crimes committed by their employees, executives and other individuals acting on behalf of the company if committed in the interest of or to bring an advantage to the company. The same legislation however provides for the possibility for companies to adopt organization models aimed at preventing crimes so that if a crime occurred the company, at certain conditions and within certain limits, might be exempted from responsibility.
