Clarification on Citizenship by Descent: New Government Directive
On May 28, 2025, the Italian Government issued Directive No. 26185 to clarify key elements of the new citizenship law (Law No. 74/2025), which amended Law No. 91/1992. Among several points addressed, a noteworthy clarification concerns Article 3-bis, paragraph 1, letter c of Law 91/1992. This provision introduces a new alternative requirement for applicants seeking citizenship by descent (jure sanguinis): the applicant must have a parent or grandparent who holds—or held, at the time of death—exclusively Italian citizenship.
The directive specifies that this condition must be met “on the date of the event giving rise to acquisition”—for example, the applicant’s date of birth in the context of a jure sanguinis application (“[…] La data in cui deve sussistere questo requisito è la data dell’evento che dà luogo all’acquisto della cittadinanza. Ad esempio, se è richiesto il riconoscimento della cittadinanza iure sanguinis, si considererà la situazione alla data della nascita dell’interessato: se a tale data un genitore o un nonno ha esclusivamente la cittadinanza italiana, l’eccezione di cui alla lettera c) si applica; se un genitore o un nonno sono deceduti prima della nascita dell’interessato, si dovrà verificare se al momento della morte erano esclusivamente italiani. Deve precisarsi che, rimanendo ferma l’operatività dei già esistenti meccanismi di trasmissione della cittadinanza, la presente condizione di cui alla lett. c) opererà sempre che la linea di trasmissione della cittadinanza italiana sia rimasta intatta. Therefore:
- If your parent or grandparent held only Italian citizenship at the time of your birth, the requirement appears to be deemed satisfied.
- If the relevant ancestor passed away before your birth, they must have held exclusively Italian citizenship at the time of their death.
Importantly, all previous transmission criteria still apply. This means the lineage must be direct and uninterrupted for citizenship to be recognized.
